The fragile-customer offer

These texts are templates and information. This is not legal advice.

The code uses “clientèle fragile” for a person the bank has identified as being in financial difficulty. It is not a reproach. The bank decides whether that applies to you. Fleuris repeats the published rules and prepares a letter, which you send yourself.

Who can be concerned

Article R. 312-4-3 of the monetary and financial code describes this judgment. The bank makes it from repeated payment incidents or account problems over three months in a row, and from the money credited to the account. Five or more incidents in a single month mean the person is treated as fragile for at least three months. The code also treats as fragile a person listed for three months in a row on the Banque de France cheque file because of an unpaid cheque or a card withdrawal, and a person whose over-indebtedness application has been declared admissible, for as long as they stay on the FICP register. The bank sets the income threshold. Fleuris cannot tell you that you meet these conditions.

The caps

Once the bank has identified you as a fragile customer, it caps nine incident fees, including the intervention fee, at €25 a month. The specific offer costs at most €3 a month, not counting incident fees. That price is updated each year with the INSEE consumer price index excluding tobacco. The Banque de France still states a maximum of €3 a month. With the offer, the incident fees it lists are capped at €20 a month and €200 a year. The intervention fee on that offer is capped at €4 per operation and €20 a month. Without the offer, it is capped at €8 per operation and €80 a month. Overdraft interest sits outside the incident-fee cap. The offer includes at least a card that checks the balance on every payment, four SEPA transfers a month, an unlimited number of direct debits, and balance alerts. The Banque de France notes that a chequebook is not part of it.

How to ask for it

Write to your bank and ask it to check whether you count as a fragile customer and, if you do, to offer you the specific offer. The bank has to make that offer on paper or on another durable medium. You are free to accept it or to refuse it, and you can leave it later in writing. The letter below is ready to fill in.

The letter

The letter is in French, because it goes to a bank in France. Fleuris does not send it.
